Terms and Conditions

1. Introduction

These Terms and Conditions govern the use of https://www.hempcoasterly.com and purchases made from Hempcoasterly (“we”, “us” or “our”).

Hempcoasterly offers cotton and linen placemat and coaster sets to customers in European markets. By accessing our website or placing an order, you agree to these Terms and Conditions, subject to any mandatory rights that apply under the laws governing your purchase.

Please read these terms before placing an order. They explain the ordering process, payment arrangements, delivery, returns, refunds, product issues and the responsibilities of both parties.

Brand: Hempcoasterly

Email: coast@hempcoasterly.com

Website: https://www.hempcoasterly.com

2. Eligibility and Website Use

You must have the legal capacity required under the laws applicable to you to enter into a purchase contract.

You agree to use our website for lawful purposes and to provide accurate information when placing an order or contacting us. You must not knowingly provide false order information, interfere with the normal operation of the website, or use our services for unlawful activities.

We may take reasonable steps to review suspicious orders, correct administrative errors and address activity that appears unlawful or inconsistent with these terms. Any restriction or cancellation will be handled in accordance with applicable law and any contractual obligations already established.

3. Products and Product Information

Our collection consists of cotton and linen placemats, coasters and coordinated sets for everyday dining.

We aim to provide clear and accurate product descriptions, including relevant information about materials, dimensions, colours, quantities and set contents.

Customers should review the information on the relevant product page before ordering. Product colours may appear differently depending on individual display settings and lighting conditions. Such variations do not remove any applicable rights where a product materially differs from its contractual description.

The characteristics and quantity of the items included in an order are determined by the product information and order confirmation applicable to that purchase.

4. Prices, Taxes and Payment

Prices are displayed on the website in the currency indicated at checkout. Applicable taxes, delivery charges and other costs payable by the customer will be shown before the order is submitted, where required by law.

Customers are responsible for reviewing the order summary, delivery details and total amount before completing a purchase.

Payment is processed through Stripe, our payment processing provider. Available payment methods are displayed during checkout and may vary according to location and transaction requirements.

An order is not considered paid until the payment has been successfully authorised or completed, as applicable. We will provide an order confirmation after the purchase has been accepted.

If a payment is declined or cannot be completed, we may be unable to proceed with the order. Where an order has been paid for but cannot be fulfilled, we will arrange an appropriate refund in accordance with these terms and applicable law.

All purchases under these terms are one-off transactions. We do not create recurring subscriptions through the ordinary purchase process described here.

5. Order Submission and Acceptance

When you submit an order, you are making an offer to purchase the selected products at the stated price and under the terms applicable at that time.

An order confirmation email acknowledges receipt of your order. Acceptance of the order will occur in accordance with the checkout process and applicable contract law.

Please check your contact details, delivery address, selected products and quantities before submitting your order.

If you identify an error after ordering, contact coast@hempcoasterly.com as soon as possible. We will review the request and determine whether the order can still be amended or cancelled before dispatch.

Once an order has entered the dispatch process, changes may no longer be practicable. This does not affect any cancellation, withdrawal or other rights available under applicable law.

Where we cannot fulfil an accepted order, we will notify you and refund any payment received for the unfulfilled order, subject to applicable legal requirements.

6. Shipping and Delivery

6.1 Dispatch Location and Delivery Partners

Orders are dispatched from Canada. We work with established delivery providers, including DHL, FedEx and UPS Priority services, depending on the shipment and destination.

6.2 Processing and Estimated Transit Time

The estimated transit time is 5–12 business days from dispatch. This is an estimate rather than a guaranteed delivery date.

The total time between placing an order and receiving it may include order processing, packing, dispatch and transit. Any separate processing estimate stated on the website or during checkout should also be taken into account.

Delivery estimates may be affected by the destination, carrier operations, customs procedures where applicable, public holidays and other circumstances affecting transport.

6.3 Tracking Notifications

We send tracking emails automatically to the email address provided at checkout at relevant stages of the shipment, where tracking information is available. These notifications may include:

  • Order dispatch.
  • Arrival at a carrier facility or logistics point.
  • Progress through the delivery network.
  • Local delivery or an out-for-delivery update, where available.

Customers should check their email, including spam or junk folders, for these notifications. Please contact us if the tracking information is unavailable or appears inconsistent with the status of the order.

6.4 Delayed or Missing Deliveries

If your order has not arrived within the estimated transit period, contact coast@hempcoasterly.com and include your order number.

We will review the tracking information and, where appropriate, open an investigation with the relevant carrier. Following that investigation, we will determine the appropriate resolution based on the circumstances, which may include a full refund or a replacement shipment.

Any investigation or carrier response will not remove or suspend statutory rights that apply to the order. Where applicable law requires a particular remedy or deadline, we will comply with that requirement.

6.5 Risk and Delivery

The risk of loss of or damage to goods remains with Hempcoasterly until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, except where a different rule is lawfully applicable to the particular delivery arrangement.

The transfer of goods to a carrier does not, by itself, transfer the risk of loss or damage to the customer.

Customers should provide a complete and accurate delivery address and any necessary delivery information. If delivery is unsuccessful because of incorrect details supplied by the customer, we will review the circumstances and the available options in accordance with applicable law.

7. Right of Withdrawal: 14-Day Returns

7.1 Withdrawal Period

Where the statutory right of withdrawal applies to your purchase, you may withdraw from the contract without giving a reason within 14 days of receiving the goods.

For an order consisting of multiple goods delivered separately, or goods delivered in several lots or pieces, the withdrawal period will be calculated in accordance with the applicable legal rules.

To exercise this right, notify us clearly within the applicable period by emailing:

coast@hempcoasterly.com

Please include your order number, the products you wish to return and a clear statement that you wish to withdraw from the purchase.

You may use the model withdrawal wording below, but you are not required to use a particular form if your intention to withdraw is otherwise clear.

7.2 Returning the Goods

After notifying us of your withdrawal, you must send the goods back without undue delay and, where the applicable statutory rules require it, no later than 14 days after informing us of your decision to withdraw.

Unless we agree otherwise, goods should be returned to the return address supplied by our customer service team.

Customers may be responsible for the direct cost of returning goods where permitted by law and where they were properly informed of that responsibility before the purchase.

Goods should be handled only to the extent necessary to establish their nature, characteristics and functioning. Where handling goes beyond what would reasonably be permitted in a shop, a lawful deduction for diminished value may apply.

Opening the packaging does not, by itself, automatically remove a statutory right of withdrawal. Any exception or deduction must be based on the applicable legal requirements and the circumstances of the return.

7.3 Refunds for Withdrawn Orders

When a valid withdrawal is exercised, we will reimburse payments received for the relevant goods and the standard outbound delivery cost where required by law.

If you selected a more expensive delivery method, we are not required to reimburse the additional cost beyond the least expensive standard delivery option where the applicable law permits that treatment.

Refunds will be made without undue delay and within the statutory period, generally no later than 14 days after we are informed of your decision to withdraw. Where the law allows us to withhold a refund until the returned goods are received or evidence of dispatch is provided, we may do so.

Refunds will normally be issued to the original payment method unless another arrangement is agreed with you and permitted by law. Any applicable statutory deadline takes precedence over an estimated processing time stated elsewhere on our website.

8. Damaged, Defective or Incorrect Goods

We take product-related enquiries seriously. If your order arrives damaged, appears defective or does not match the goods ordered, contact coast@hempcoasterly.com.

Please provide:

  • Your order number.
  • A brief description of the issue.
  • Clear photographs showing the affected item and the relevant damage, defect or discrepancy.
  • Photographs of the outer packaging where these help explain the issue.

We will review the information and may request further details where reasonably necessary to assess the matter.

8.1 Resolution Without Return

Where the photographs and other available information sufficiently establish the issue, we may resolve the matter without requiring you to return the affected item.

Depending on the circumstances and applicable law, the resolution may include:

  • A full refund for the affected goods.
  • A replacement item or replacement shipment.
  • Another remedy agreed with the customer where legally permitted.

Where the issue is sufficiently established, we will not routinely require the damaged item to be returned merely to begin reviewing the claim.

8.2 Statutory Remedies

Nothing in this section limits statutory rights concerning defective, damaged, misdescribed or otherwise non-conforming goods.

Depending on the applicable law and circumstances, the customer may be entitled to repair, replacement, a price reduction, termination of the contract or a refund. The availability and order of these remedies are determined by the applicable legal rules.

A request for photographs is intended to help us assess the issue. It does not remove a customer’s statutory rights or prevent a claim from being assessed through another reasonable method where appropriate.

9. Refund Processing

Once a refund has been approved, it will normally be issued to the original payment method.

The time taken for the refunded amount to appear in the customer’s account may depend on the payment method and the relevant financial institution. Any processing estimate we provide is separate from the deadline by which a refund must be issued under applicable law.

We will provide relevant confirmation when a refund has been processed.

Refunds for cancelled or unfulfilled orders, valid withdrawals, damaged goods and other approved claims will be handled according to the circumstances of the order and the legal requirements that apply.

10. Cancellations and Amendments

If you wish to cancel or amend an order, email coast@hempcoasterly.com as soon as possible and provide your order number.

We will review whether the order can be changed before dispatch. A request submitted after dispatch may not be capable of being processed as an ordinary order amendment.

If cancellation is not possible before dispatch, you may still exercise any applicable statutory withdrawal rights after receiving the goods.

We reserve the right to cancel an order where there is a lawful and reasonable basis, including where a product is unavailable, a material pricing or listing error has occurred, payment cannot be completed, or the order cannot lawfully be fulfilled.

Where we cancel an order after payment has been received, we will arrange the appropriate refund in accordance with applicable law.

11. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Subject to that requirement, Hempcoasterly will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time the contract was formed, to the extent such limitation is permitted by law.

We are not responsible for losses arising solely from inaccurate information supplied by the customer, unlawful use of the website or circumstances outside our reasonable control, except where applicable law provides otherwise.

Nothing in this section excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct where liability cannot lawfully be excluded, or any other liability that cannot be restricted under the governing law.

Customers retain all mandatory rights that apply to their purchases, including relevant rights relating to delivery, conformity of goods, withdrawal and refunds.

12. Events Beyond Reasonable Control

Where events beyond our reasonable control materially affect our ability to fulfil an order, we will take reasonable steps to assess the impact and communicate relevant information to affected customers.

Such events may include severe weather, transport interruptions, natural disasters, public emergencies or government measures.

This section does not automatically release either party from contractual obligations or remove any remedy that must remain available under applicable law. Where an order cannot be fulfilled, we will handle cancellation and refunds in accordance with the circumstances and applicable legal requirements.

13. Intellectual Property and Website Content

Website text, photographs, graphics and other materials used by Hempcoasterly are owned by the relevant rights holder or used on a lawful basis.

You may access and use website content for personal, non-commercial shopping purposes. You must not reproduce, distribute, modify or commercially exploit website content without the necessary permission from the relevant rights holder, except where applicable law permits such use.

Nothing in these Terms and Conditions grants a licence or transfers ownership of intellectual property rights.

14. Privacy and Personal Information

Personal information collected through our website is handled in accordance with our Privacy Policy.

Information may be used to process orders, arrange delivery, manage refunds, respond to enquiries, maintain business records and meet applicable legal obligations.

Payments are processed by Stripe. Relevant customer and transaction information may be shared with Stripe and other service providers where necessary to complete a purchase or perform related activities.

For further details concerning the collection, use, disclosure, international transfer and retention of personal information, please consult our Privacy Policy at https://www.hempcoasterly.com.

15. Complaints and Dispute Resolution

If you have a concern about a purchase, delivery, product or refund, please contact coast@hempcoasterly.com and include your order number and relevant details.

We will review the information provided and seek to identify an appropriate resolution in accordance with these terms and applicable law.

Where a dispute cannot be resolved directly, either party may pursue the remedies available through the competent courts or other dispute resolution procedures applicable to the matter.

Nothing in this section requires a consumer to waive a statutory right to bring a claim before a competent court or to use a dispute resolution process where participation is not legally required.

16. Governing Law and Mandatory Rights

These Terms and Conditions are to be interpreted in accordance with the laws applicable to Hempcoasterly’s operations in Canada, subject to any mandatory consumer protection and conflict-of-law rules that apply to the particular purchase.

Where a customer resides in an EU Member State or another European jurisdiction with mandatory consumer protection rules applicable to the transaction, nothing in these terms is intended to deprive that customer of protections that cannot lawfully be excluded by contract.

The applicable court jurisdiction will be determined in accordance with the relevant legal rules. No provision in these terms is intended to override mandatory rules governing consumer jurisdiction or the enforcement of statutory rights.

17. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, that provision will be applied to the extent legally permitted or treated as severable where appropriate.

The remaining provisions will continue to apply to the extent that they remain valid and enforceable. This section does not permit any term to override mandatory legal protections.

18. Changes to These Terms

We may revise these Terms and Conditions when our business practices, products or applicable legal requirements change.

The latest version will be published on this page with the updated date. Changes will not retrospectively remove rights that have already accrued under an existing contract, except where permitted by law.

The terms applicable to an order will be determined in accordance with the contract formed at the time of purchase and the applicable legal requirements.
